It's no different from arresting a suspicious Muslim guy for burning down Bibles in the middle of the street. Bible and Qu'ran are not symbols of the United States, therefore they shouldn't be regarded as important, of course. I don't care about that toy flag, but I would argue that the official flag of the United States is not merely private property, but a symbol of the nation and its people. The act itself might be legal, and does not lead to any criminal charges, but the act does lend enough weight to suspicions that the person might be involved with other potentially criminal behaviour, and is therefore taken for questioning, on the pretense of disorderly conduct or whatever.

It gives him a lesson in reality about actions having potential repercussions, something that his parents must have missed out on during his upbringing, while technically the burning of a flag will still remain de-criminalized since the guy is probably going to be let free of any charges. To a hard-line defender of liberty it might sound rough, but arresting this dude, at the end of the day, does not do anybody any harm.

If people do not know how to operate within a free society without causing a mess, then a more totalitarian government will eventually be instilled in its place, to enforce proper behaviour through law. That's just the crude reality, if you do not prove yourself worthy of freedom, then eventually it will be taken away from you.

If people end up doing nothing productive with their deemed freedoms, then sometimes they ought to be reminded of their value by having them taken away. The people who were born today do not seem to understand that Americans weren't merely "born" with all of their freedoms and privileges, they earned them and actively fought for them. Generation upon generation, worked hard in order to create a society where a guy like this can do whatever he damn well pleases and get away with it. should criminalize flag burnings, but they ought to understand where other countries are coming from with incidents such as this.
